Spanish Data Protection Authority Has Issued an Update on Cookies Guidelines

Spanish Data Protection Authority, Agencia española deprotección de datos (AEPD), has updated its Cookies Guidelines.


Particularly, the changes from the previous Guidelines are around the method of obtaining the consent as continuing to browse the website, scrolling,clicking the link etc, which are not deemed as valid methods to obtain consent anymore.


“Cookie walls” were allowed in the past under certain conditions, however, the threshold for having them on the website is higher now.The AEPD has highlighted that if users refuse consent for accepting the cookies, then an alternative access to the services must be offered without having to accept the use of cookies. Such service must be equivalent to the originally requested service and it cannot be offered by the entity other than the website publisher.


These Guidelines must be implemented by October 31, 2020.
